Rule 23
Duration and Renewal Procedure of Permit
(1) The license obtained by the organization providing orientation training shall be valid for one financial year. Regardless of the date on which the license is granted, the term of such license will expire at the end of that financial year.
(2) Organizations providing orientation training may renew the license by submitting the following details within the end of June of each financial year:-
(a) Progress of previous financial year,
(b) Physical, financial and human resources of the organization,
(c) Proof of tax filing for the previous financial year as per prevailing law,
(C1) Details of registration of the company from the office of the company registrar or proof of renewal of the license up to the previous financial year,
(d) Other necessary details prescribed by the department.
(3) According to sub-rule (2), a fee of ten thousand rupees will have to be paid when the license is renewed.
(4) Organizations that are conducting training with a permit at the time of commencement of the Act may submit an application to the department within one year from the date of commencement of this regulation for the renewal of the permit they have received, and upon examination of such application, if the department deems the infrastructure, manpower and other resources of such organization sufficient, the bond as per Rule 22 And the permission of such organization should be renewed after receiving the license fee. The licensee who does not renew within the deadline will not be allowed to conduct training business.
(5) If the permit is not renewed according to sub-rules (2) and (4), such permit will be cancelled.
(6) Notwithstanding anything written elsewhere in this regulation, if an organization providing orientation training is found to have done any work contrary to the Act and these regulations, the department may suspend or cancel the license of such organization for a certain period.
(7) Before canceling the license in accordance with sub-rule (6), the department shall give reasonable opportunity to the concerned organization to submit its justification.
(8) Notwithstanding anything else written in this rule, the director of the licensed organization and the family members of his immediate family, as per rule 21The organization will not be allowed to operate.
(9) Notwithstanding anything contained elsewhere in this rule, no license shall be granted or renewed to more than one institution under rule 21, which is owned by a family member of a household, after the commencement of this rule.
(10) According to sub-rule (9) at the time of commencement of this rule, if there is more than one organization in which the members of a single household share a share, such organizations may be merged with each other.
